These terms govern the use of Sirvis (the application and the website at sirvis.app) by the business that holds an account. By using the service, the business accepts these terms together with Annex A.

The service is offered to professionals and businesses only, not to consumers.

2. The service

Sirvis is an application for heating and air-conditioning technicians. It keeps the list of your customers and their machines, works out when each one is due for service, sends your customers an SMS reminder on your instruction, and records your requests, appointments and jobs.

We improve the service continuously. Features may be added, changed or withdrawn; we do not remove a material feature of your subscription without reasonable notice inside the application.

3. Account and access

  • An account is opened only by our invitation. The business owner sets their own password and is responsible for whatever is done with it.
  • The password is not shared. If you suspect someone else has learnt it, change it and let us know.

4. Free trial

Every new business has 14 days free from the moment it sets a password, with no card. During the trial you can send up to 150 SMS. When it ends, the application stays open with all your data; only the sending of messages stops, until you start a subscription. If you do not start one, you are charged nothing.

5. Subscription, prices and VAT

  • The plans, their prices and the SMS they include are those shown on sirvis.app and in «Subscription» inside the application at the time of payment.
  • Prices are net; VAT at 24 % is added. The subscription is charged in advance, monthly or yearly, by card through Stripe; the card details never reach us.
  • Each plan includes a set number of SMS per calendar month for service reminders, and separately a number of SMS for visit reminders. While visit reminders are off, their SMS not sent in the month are added to those of the service reminders. Unused ones do not carry over, and there is no extra charge beyond them: sending SMS simply stops until the start of the next month; visit reminders then go by email, to customers who have one.
  • If a payment fails, sending continues for 7 days while the card is retried, then stops until it is paid. The application and your data stay.
  • A price change is announced inside the application at least 30 days before it takes effect and never touches a period you have already paid for.
  • To change plan, write to us at [email protected] or +30 697 924 4944.

6. Invoices

For every payment we issue a services invoice (τιμολόγιο παροχής υπηρεσιών), which is transmitted to myDATA. We email it to the invoice address you gave in «Subscription» or, if you gave none, to the account email. Stripe’s receipt is not an invoice.

7. Messages to your customers

You decide which customers receive a message: no service reminder leaves unless you press «Send». For every visit you book, the customer automatically gets one reminder of it, at the time you set in Settings («Visit reminder»), where you can also turn it off. You are responsible for the lawful basis of your communication with your customers.

Every SMS with a link gives the customer a way to stop the messages («Stop these messages»). When you send without a link («Your phone number»), the request to stop comes to you, and you record it with «Don't send them messages».

We hand messages to the SMS provider. «Στάλθηκε» (sent) means the provider accepted it, not that it reached the customer’s phone. For anything urgent, call.

8. Your data

The data you enter is yours. We do not sell it, do not share it beyond the providers in the Privacy policy, and do not use it for our own purposes.

You can download at any time, free of charge, your customers, machines and jobs in Excel, or all your data in one file, from Settings → «Your data». You can also ask for it at [email protected], and we send it within 30 days.

The processing of your customers’ data is governed by Annex A.

9. Acceptable use

  • Do not enter data you have no lawful right to, and do not message anyone who is not your customer.
  • Do not write health data or other sensitive data about your customers in «Notes».
  • Do not attempt to reach another business’s data, or to bypass access controls.
  • Do not place a disproportionate automated load on the service.

10. Availability and support

We do what is reasonable to keep the service running, without guaranteeing uninterrupted operation.

Support at [email protected] or +30 697 924 4944, on business days.

11. Liability

To the extent the law allows, our total liability for any claim arising from use of the service is limited to the amount you paid for the subscription in the twelve months before the event.

We are not liable for lost profits or indirect damage. Nothing in these terms limits our liability for wilful misconduct, gross negligence, or anything the law does not allow to be limited.

12. Cancellation and refunds

You pay by card inside the application, for a month or a year, and receive an invoice for every payment. You can stop the subscription whenever you like from «Subscription»: it stays active until the end of the month or year you paid for, and the money for that period is not refunded.

  • You cancel with «Cancel subscription» in «Subscription» (Settings). Until the period ends you can undo it.
  • There is no refund for part of a period, nor for a yearly subscription cancelled before it ends.
  • If you believe you were charged in error, write to us at [email protected] before opening a dispute with your bank. We check it, and a charge made in error is refunded in full.
  • We may terminate the agreement for a material breach of these terms or for prolonged non-payment, after notifying you and giving you a reasonable period.
  • After the end, your account and data stay; only the sending of messages stops. You download them whenever you like from «Your data», or ask us for a copy or for their deletion, and we do it within 30 days.

13. General

Annex A is part of these terms and is accepted together with them; no separate signature is needed.

Material changes to these terms are announced inside the application at least 30 days before they take effect, and you are asked to accept them.

Greek law applies and the courts of Thessaloniki have jurisdiction, subject to mandatory law.

Annex A — Data processing agreement (GDPR Art. 28)

This Annex governs the processing of personal data we carry out on your business’s behalf. The BUSINESS is the controller and we are the processor.

A1. Subject matter, duration, nature and purpose. The subject matter is the provision of Sirvis. Processing lasts for as long as your account exists. Nature and purpose: storing, organising, displaying and sending messages on the business’s instructions, including the automatic reminder of the visits it books, while it keeps that on.

A2. People and data. People: the business’s customers and those who sign in to its account. Data: as listed in §2 of the Privacy policy. We do not process special categories of data (GDPR Art. 9); this is why we ask you not to write such data in «Notes».

A3. Our obligations. We process the data only on your instructions; using the application is such an instruction. Everyone with access is bound to confidentiality. We apply the security measures in §7 of the Privacy policy. We help you answer requests from the people the data concerns and cooperate with the supervisory authority. We notify you without undue delay of any breach affecting your data, with what you need for your own notification within 72 hours. We provide the information that shows our compliance and accept audits, on reasonable notice and under confidentiality.

A4. Sub-processors. The business gives general authorisation for the providers in §4 of the Privacy policy. We announce any new provider inside the application before it starts; you may object within 30 days and, if no solution is found, leave without penalty.

A5. Transfers. Transfers outside the EU take place only with the safeguards in §5 of the Privacy policy (Standard Contractual Clauses or an adequacy decision).

A6. At the end. The business downloads the data whenever it likes from «Your data». When you ask, we send you a copy of the data and then delete it, within 30 days, except what the law requires us to keep.
